INTRODUCTION

These General Terms & Conditions (“Terms”) govern all use of the ZUUVR website (zuuvr.com) and any purchase, inquiry, or project engagement with ZUUVR BV. By accessing our website or entering into an agreement with us, you agree to these Terms.

2. APPLICABILITY

These Terms apply to all visitors of zuuvr.com, all requests for information or quotations, and all agreements entered into between ZUUVR BV and the client, whether the client is a consumer or a business (“B2B”).

ZUUVR BV reserves the right to update these Terms at any time. The version in force at the time of your order or agreement applies. Deviations from these Terms are only valid if explicitly agreed upon in writing.

 

3. PRODUCTS & SERVICES

ZUUVR BV offers premium pool products and related ecosystem solutions. Our product range includes, but is not limited to, ZERO, DEKK, WAAS, and SHINE.

Product descriptions, images, and specifications on our website are for informational purposes and subject to change without prior notice. ZUUVR BV makes reasonable efforts to ensure accuracy but cannot guarantee that all information is complete or error-free at all times.

For custom projects or tailored installations, a separate written agreement or quotation will govern the specific scope, timeline, and pricing.

 

4. QUOTATIONS & ORDERS

Quotations

All quotations issued by ZUUVR BV are non-binding and valid for 30 days unless stated otherwise. A quotation does not constitute a binding offer until explicitly confirmed in writing by ZUUVR BV.

Orders

An order is considered confirmed once ZUUVR BV has sent a written order confirmation. ZUUVR BV reserves the right to refuse or cancel orders in exceptional circumstances (e.g. stock unavailability, pricing errors), in which case any payment already made will be refunded in full.

 

5. PRICING & PAYMENT

All prices are stated in euros (€) and exclude VAT unless indicated otherwise. For B2B clients, prices are always listed excluding VAT.

Payment terms are specified in the quotation or order confirmation. Unless agreed otherwise:

  • An advance payment of 30% is due upon order confirmation
  • The remaining balance is due before or upon delivery
  • Invoices are payable within 30 days of invoice date

Late payments are subject to statutory interest in accordance with Belgian law (Act of 2 August 2002 on combating late payment in commercial transactions).

 

6. DELIVERY

Delivery timelines communicated by ZUUVR BV are indicative and not binding unless explicitly agreed in writing. Delays do not entitle the client to cancel the order or claim compensation, unless the delay is unreasonable and ZUUVR BV has been given written notice to remedy the situation within a reasonable timeframe.

Risk of loss or damage transfers to the client upon delivery. For international shipments, delivery terms (Incoterms) will be specified in the order confirmation.

 

7. RETURNS & COMPLAINTS

Visible defects or non-conformities must be reported to ZUUVR BV within 5 business days of delivery at info@zuuvr.com, with photographic evidence where possible. Hidden defects must be reported promptly upon discovery.

Returns are only accepted after prior written approval from ZUUVR BV. Products must be returned in original condition and packaging. Return shipping costs are at the client’s expense unless the return is due to an error by ZUUVR BV.

Consumer right of withdrawal

If you are a consumer (non-business buyer) and purchase online, you have the right to withdraw from the agreement within 14 calendar days of receiving your order, without giving any reason. To exercise this right, notify us at info@zuuvr.com before the deadline. This right does not apply to custom-made or personalised products.

 

8. WARRANTY

ZUUVR BV products are covered by the statutory warranty. For consumers, this is a minimum of 2 years from the date of delivery in accordance with Belgian and EU consumer law. For B2B clients, warranty terms are as specified in the product documentation or order confirmation.

Warranty does not cover damage resulting from improper use, lack of maintenance, external factors, or modifications made without written approval from ZUUVR BV.

 

9. LIABILITY

ZUUVR BV’s liability is limited to direct damages and capped at the value of the relevant order or agreement. ZUUVR BV is not liable for indirect or consequential damages, including but not limited to loss of profit, loss of data, or third-party claims.

ZUUVR BV is not liable for damages resulting from circumstances beyond its reasonable control (force majeure), including natural disasters, strikes, supply chain disruptions, or government measures.

 

10. INTELLECTUAL PROPERTY

All content on zuuvr.com, including but not limited to texts, images, logos, product designs, and brand identities,  is the exclusive intellectual property of ZUUVR BV. Nothing on this website may be reproduced, distributed, or used commercially without prior written permission from ZUUVR BV.

 

11. PRIVACY

ZUUVR BV processes personal data in accordance with its Privacy & Cookie Policy, which forms an integral part of these Terms.

 

12. GOVERNING LAW & DISPUTES

These Terms are governed by Belgian law. In the event of a dispute, both parties will first seek an amicable resolution. If no agreement is reached, disputes will be submitted to the competent courts of the judicial district of Hasselt, Belgium.

For consumers within the EU, the European Online Dispute Resolution platform is also available at ec.europa.eu/consumers/odr.
